Sorry that I haven't been posting much lately (understatement of the year LOL). I think I was burnt out running this blog, and with a new job occupying most of my days, I simply didn't have much energy and time to update the blog.
Well, tomorrow's SMTOWN Live will surely motivate me.
Can't wait to see all the SMTOWN artists (TTS!!!) and of course our boys, TVXQ perform.
It would be exciting to see TVXQ perform their new songs and the old songs. I hope they perform Mirotic & Rising Sun, two of my favorites from their old catalog.

ReplyDeleteAll the current court sessions are being held closed doors, so no info is available. Even if JYJ win the case, there's no way YH & CM would join them. It simply doesn't make sense. The lawsuit is between SM & the 3 so the outcome of it would not affect YH & CM's relationship w/SM, who btw have worked together all these years to make TV2XQ a huge success. I highly doubt SM would risk losing the fans of TV2XQ at this point. With everything the 3 had done, re-union would totally tarnish TVXQ brand, especially in Japan.
Deletei agree with you completely. it really doesn't make sense for SM to reunite them any more. maybe if this happened a year or so ago then it might have worked but now TVXQ has re-established itself once again as a legend in the sky of Asian music. TVXQ's new fans who make up the majority of the current fandom as i see it find HoMin as inspirational figures for the actions they took throughout this mess. they want to support them not just becuz of their music but becuz of the attachment they feel to them after what they had to go through. it would cost SM even more now to re-unite the two bands that it did when they split before

Think it was announced that the courts would make their final ruling on the case sometime next month (can't remember the exact date). Yay. Hopefully that will be the end of it, regardless of what the outcome is. Or at least the beginning of the end. Of the delusions and fanwank. Maybe those never end. Whatever.

ReplyDeleteI can't wait for the final decision. This case was dragged for so long. Don't listen to those delusional OT5 who still think that a reunion will be possible (AKTF anyone?). TVXQ2 is doing well on its own. YH and CM worked really hard (and continuously working hard) to re-establish TVXQ's name. I'm proud of our boys. President LSM even once said to Yunho that he and Changmin will just do fine as a duo (after watching the performances in SMTown 2010), hence the comeback in early 2011. If LSM (and the other board members of SME) didn't believe in them, our boys would've been let go. You see, it's not just about the money. It's also about hard-work, clear conscience, trust and continuing to pursue one's dreams. TVXQ Fighting! We are 'T'.
Also, if JYJ wins the case, they can no longer use the name "TVXQ" in their names or be associated with it (I guess we should stop seeing "JYJ from TVXQ"), since their contract will be voided.
I hope more accounts will come-out once this is over. Truth shall prevail.
But for the case, I really want SME to win.It will be a HUGE shove in the face for JYJ fans or whatever it is people call them.

my perfect scenario would be to have SM win too becuz i believe that the truth is on their side. then i would like to have them release JYJ from their contract with them once JYJ pay back the money agreed upon. singers need to realize that its not ok for them to sign a contract that they may not consider fair and then try to annul it once they are super famous with a massive fanbase that will do anything for them. its very unethical and unprofessional. and they need to stop with the whole "we were young and rash" excuses! they had their parents right next to them to help them and guide them! where their parents also young and rash to allow their kids to do this!?? please!
ReplyDeleteJunsu spent 6-7 years training at SM before debuting with TVXQ in 2003. that means that he was 10-11 years old when he joined SM and signed the trainee contract which was supposedly cheap and unfair! are these people telling me that Junus's parents had no idea of their son joining SM at 11 years old and training with them for years, and then appearing on TV shows with enhyuk and sungmin before his debut with TVXQ! seriously! what about in 2008 when it was common knowledge that Junsu's parents were having negotiations with SM to get their other son into the company as well. later on fans never stopped showing their displeasure at SM for rejecting junus's brother, who btw is currently signed to AVEX! yet hes still on really good relation with his family despite having signed with the "enemy"! clearly the family only cares about money and nothing like the feelings of their younger son who was betrayed by that specific company whom hes currently fighting against..pathetic!
considering all the pictures and accounts of JYJ's millions that they have been saving since the split and using to buy houses, apartments, and dozens of brand new cars costing millions of dollars, im pretty sure they are more than capable of paying SM back to release them from their contract legally.

though, i have a question to anyone who might know more about this. in one week there is the date for the final decision, however i found a really interesting post on a quite radical JYJ site, claiming that SME's lawyers applied for arbitration.
as usual the site makes it sound like SME is desperate to win the case and all and after a long time i even read the expression hotel-girl again. i might not like the way the article is written, but the facts stated refer to reality in some way. so what is it all about this arbitration an all the other foul tricks SME is claimed to perform?

ReplyDeleteActually I already raged on twitter because of that post (and the article in you know where), not because I think they are lying about SM filing an arbitration, but because how the prejudiced assumption that comes with that. Just my thoughts on that particular topic:
1. Where did the info come from? Now, I think the blogger (widmung) was the same person who posted a screencap of the ruling schedule from Seoul District Court, but this post came without any link. It makes me wonder if the information about SM's arbitration was something available to the public, or did someone leak the information out. I personally am amazed how easily 'the members' lawyers' complained about these things to fans. Don't they have a code of conduct or something? Then again, the lawyers also brought up the whole thing about Jung supposedly going to be rotated out of the 'Dream Team', so I guess I don't have any respect for them anyways, LOL...
2. An arbitration is a VALID LEGAL ACTION, it is a way to resolve dispute outside of court (contrary to litigation). It's not something SM's lawyers came up by themselves, it is something that already exists within the legal system. If by applying for an arbitration someone is automatically guilty of 'employing dirty tricks to postpone the court' then anyone who applies for arbitration is guilty. Isn't it way to judgmental and biased to jump the gun like that?
3. Widmung isn't SM, JYJ3 isn't SM, ChunJaeSu's lawyer isn't SM, so why on earth are the so sure on the motivation behind SM's action? The people who knew why SM filed an arbitration is SM and their lawyers. Unless they explain why they did it, I say nobody really know why they did it.
4. IF SM did file an arbitration to 'postpone' the ruling, all I can say is... So what? ChunJaeSu (and their lawyers) also failed to file the lawsuit a week after they received an injunction in 2009, they didn't file it until about 6 months later (in fact they filed the lawsuit AFTER SM filed a lawsuit to validate the contracts). That too can be considered 'postponing' the court, no? So it's okay when ChunJaeSu does it but an outrage when SM does? Please... Again, biased and prejudiced.
5. Like widmung explained in her post, it is up to the court whether they want to approve SM's request for arbitration or not... If it does get approved, and the court gets postponed, guess who's to blame? The court... Why did they approve the request on the first place? Blaming SM for filing an arbitration is like blaming ChunJaeSu for filing an injunction. Both sides filed for something they feel they have a right to get, don't blame them if the court grants it to them.
PS. I am no lawyer, and I am not knowledgeable about law. So I am not going to discuss technicalities because honestly, all I know is that arbitration is way to resolve a dispute outside of court. I am under the impression that people file for an arbitration BEFORE they go to court, but like widmung say, the Korean arbitration law is different, so maybe in Korea arbitration is something completely different than that, ^______^

As far as I know, JYJ's lawyers have also delayed in the past, and they have definitely turned down requests to compromise. I can't entirely remember however since this case has been going on for so long and it's been awhile since I have paid attention to it.

ReplyDeleteMaybe the final decision is not in SM's favor, which would mean that the contract will be invalidated and ChunJaeSu are no longer in the company (and TVXQ). SM will lose the penalty ChunJaeSu were supposed to pay if the contract still stands, and having to bear the brunt of JYJ stans gloating and bragging, but I am sure they will survive. ^____^

AKP just posted an article about it so I assume it has been pushed back. Also. If you read the article and how they have misreported about the events of the trial (they reported that JYJ filed the first lawsuit and SM filed the countersuit instead of it being the other way around) and the comments from most of the people posting on the article so far you may feel some rage.

But if S.M loses, then the company either got cheated by CJS's dirty tactics/South Korea's court system is downright unfair? I beg to differ. If S.M loses, I'm pretty sure that means S.M was in the wrong, and the court's verdict is supposed to prove that. However, if Precious (the writer of this blog if I'm not mistaken) can get hold of all this information about S.M being right on his own, then I'm sure South Korea's court can do the same. The links provided by Precious are from Korean sites. However, they are accompanied with official documents to back-up his translation, as the majority of us are either in the process learning Korean or just starting to learn the language. We are not bashing the members of JYJ or their fans. People think that our comments are some form of bashing, because, well, we defend SME. Our comments are based on facts, not some rumors. For example (this was a comment/conversation that other readers had before in this blog), when JYJ released their "In Heaven" album, CJeS entertainment claimed that they have sold "x" amount of the albums. We corrected this by saying that the "x" number of sales that the company released was not the official sales, but the pre-orders, which are two different things. We corrected this because we don't want hardcore JYJ fans say, "In your face SME," when their claims are not backed by facts. Eventually, Gaon chart released the official count and it wasn't even that close to what the company has originally stated. As for the lawsuit, JYJ did file an injunction first. SME proceeded to file a lawsuit and JYJ the countersuit. It was JYJ's side that failed to file the lawsuit first. My advise to you is to read this whole blog. You will be surprised with the difference with the information you will get from this blog from the other sites. You decide whether or not this blog is fake and just spreading lies. If you have a Korean friend who is neutral about this matter, ask him/her to help you with the translation of the original Korean transcripts that are found here. Feel free to keep asking us questions.
DeleteThe funny thing to me is that no one in here has ever claimed that the system was corrupt if SM lost in fact the only people who have ever claimed a corrupt system are JYJ fanatics. Who praised the system when they were on JYJ side then vilified them when they did not agree with them. I’ve read all the blog entries and the comments; no one here said that if SM loses it means the court is corrupt or ever believes that SM is an angel either; SM is a company with a company views and interests. However, I heard it quite often from the other side; court is just when it goes to JYJ favors and the court is corrupt if it goes to SM favors. All JYJ sufferings are SM fault (never JYJ or CJeS fault) because no matter what SM does or doesn’t do, SM is ‘de facto’ evil.

If I'm not mistaken Ono Toshiro is a Law journalist. I think he is interested in mafia involvement in the business/ entertainment industry, that’s why he is interested in Tohoshinki case.

Delete@fc and sarahM They should keep a close eye on him truth is the closest person to the mafia in this whole situation is CJeS boss. Everyone knows about his connections. JYJ3 has to distort that information so no one finds out just how underhanded there boss is. SM has no pull in the court of law as proven by Hangeng's case however I would not put it past CJeS boss to know some one who might be willing to you know overlook some things. Personally I don't think the courts in these type's of situations are corrupt I do believe the outcome will be a fair one regardless of who wins. But considering JYJ boss background they should be looking at him not SM.

Hangeng had a swift end to his lawsuit, i think around a year, because in the end he was willing to come to some (amicable) terms with SM. and lol at all the "SM is butthurt" comments i see everywhere. all this mess cannot be boiled down to "SM is butthurt". there are legal implications for breaking a contract and what SM is doing is exhausting every single legal means available to them to chase after the parties who breached the contract. if it is legal to file for arbitration over and over and as long as the court accepts the request then SM lawyers would just keep doing that.

ReplyDeleteTechnically, JYJ is still part of SME and TVXQ. That's why there is a lawsuit. The trio wants to invalidate their "slave" contract with SME and if the court rules in their favor, they will not have to pay the hefty fine for breaching their contract with SME. They are able to promote as JYJ because of the injunction ruling made by the court. If you are asking because of the profiles in the websites, the truth is that their profiles have always been there. Even in SMTown and Avex websites. I don't know why netizens are making a big fuss about this. I mean if you look at SMTown's website, you will still see their previous artists' pictures there (ie. Shinhwa, Fly to the Sky). As for Naver, Daum, or Nate (I'm not sure which one) listed Yunho as a "former" member, don't even bother with it. Someone must've written it in that way to cause controversy and rumor, especially when August 10 is just around the corner, when the verdict from the arbitration is going to be out. Oh well.

Of course, they will lose the money, but they will earn it back again. I'm getting tired of reading how SM is evil and b***hurt. If the company is that evil, I don't think anybody would be willing to sign a contract with them to train and eventually debut as a group. *shakes head*

I am not sure whether this is true or not, since translation from news sites could be wrong. Let's see what's going to happen next month. DeleteI know how you feel. All of the people bashing SM and again disrespecting the choice made by Changmin and Yunho have gotten me feeling quite frustrated. I really want things to go in SM's favor so they can get some sort of validation. People were saying, "Thanks to what JYJ did, SM artists got better contracts, etc etc." And were also using a statement made by a JYJ lawyer (SM just wants to forget the past) as a way to bash SM some more (although I did reply to those comments to point out that was a statement made by JYJ's lawyer and thus a biased statement). I'm just over this. And I will be sick if in September the court rules in JYJ's favor and I have to put up with all the JYJ sympathizers and SM bashers feeling vindicated because they will forever hold up SM as the evil company in the industry.

If what you say is true, they better leave Homin alone. They went through too much just to get where they are now. Seeing them having so much success after the bashing and death threats, makes me respect them more, same with SM. I agree with treya_barton, I will be angry if it does go in JYJ's favour. We would be seeing a lot stans gloating and pointing in our and SM's faces saying "I told you so." I have a feeling even if they do win ....they will bash them even more(but not as much as they would have if goes in SM's favour).

Honestly I would be skeptical about that apparent word of truth.Firstly neither side has released an official word on the stance of the contract and you know that CJeS would have been posting out the ying yang about SM being wrong and them being right if it was so. Secondly that is the only site I have even seen that says anything about the contract being invalid. Not only that but do any of you know how a lawsuit works?? Most times if the court has made the decision rather then it going to arbitration the verdict and the settlement would be read at the same time. Not your right but we will come back later and decide what you get. They would only end up back in court if an appeal was filed and it would not end up back in court that fast. It seems to me that some misunderstanding has happened which considering that as far as I know if was a closed session could happen. The information comes second hand without an official word on it is so I would not necessarily believe it as fact.

At first, like everyone else, I bashed SM....LSM in particular. But then went on to bashing KYM, after founding out some stuff about LSM(He really isnt bad as ppl think he is).

Second, seeing SM Town artists being so tired, like SNSD, Super Junior and SHINee. I already disliked SM's methods of taking care of their artists in the first place. To tell the truth I knew DB5K before knowing about the lawsuit. You can thank Super Junior's EHB for that lol. After I heard of the lawsuit, I was shocked. The 5 boys looked so happy together, so why would they break up like that? If they actually cared about Homin, why didn't they just stay together until their 13 year contract is over. I had no idea why but Homin drew me in more than JYJ even before hearing their (JYJ's) music. What drew me away further from JYJ is their crazy fans.....*shudders* their commenting are hurtful,agressesive and scary.
I didn't really think CJS had more motive than to get out of SM because the contract is unfair. I didn't bash Homin but I did wonder why would they stay at SM so many times and didn't join their `brothers'. So I tried to do my own little research about what was so unfair about the contract and why Homin would stay at SM, I found plenty of articles from the JYJ side. But I could tell it was too biased to be the truth. I was about to give up until I found your blog.
I was shocked, angry, frustrated, outraged, & etc. when I read all of your posts until now. WTH is wrong with them!? How could they throw their so-called `brothers' under the bus and be at the mercy of their(CJS) fans!? Without even trying to stop their fans bashing them!? I didn't know the existence of 6.25, Crebeau, and Forever(the only good thing I found out. I respect her/him LOL) until now. I really want SM to win no matter what. the more i know about JYJ, the more I fear them and their power to twist things around. all these years they have made and continue to create false scenarios that portray them as the innocent kicked puppies yet behind that façade resides a really scary reality. those 3 should have seriously gone into politics since they seem to be so good at playing the innocent card game. reading about their mother selling cereabeu products at THSK's concert is very shady too.
reading this also makes me fear Avex, becuz i don't think that everything stated here is true. the reason I say this is becz Avex makes it self sound like it still held honorable feelings to SM during 2009 and 2010, when in reality Avex jumped on the bandwagon to bash SM and HoMin by allowing its most impo figure in the company, CEO Max M., to publicly attack yunho and changmin on twitter. not to mention that Avex sold all their shares in SM and cut all ties to it.
from the above document, it doesn't seem like JYJ's side ordered Avex to cut all ties to SM and publicly humiliate HoMin, so i don't feel like they were forced to do that either. plus we all remember how Max M. praised jaejoong during the year-end awards about how nice and wonderful he was while HoMin refused to treat him properly. Honestly, if he really wanted to remain with SM and tried to help JYJ get back to SM, would HoMin, specifically changmin, have treated him to coldly back then? i would have thought HoMin would have stood on his side and treated him with more regard and gratefulness.
there is just something really off about the whole thing, and i dont think either side is being completely honest here.
i do think that Avex is hiding important facts that may include them being involved in encouraging JYJ to leave SM. After all Avex is a business company so it would be in their advantage if JYJ are signed exclusively with them without having a third partner in the middle (aka SM)taking a portion of the profit. but i do think that Avex didn't take into account that JYJ will be signed to a new company that may partially belong to them. i think this along with the fact that SM was suddenly at the top once again thanx to SNSD's and Shinee's success in Japan, and the sudden announcement of TVXQ's comeback that was received very enthusiastically by japanese fans (probably more so than when JYJ held their Tokyo Dome concert and released their japanese album "The..") freaked Avex a bit and made them reconsider their decision of helping JYJ.
This confirmation letter from Avex at least tells us from their point of view what was happening at that time. We will never know everything that happened to cause the split of tvxq but it confirms my support for the two membered tvxq. It was a really good decision by Yunho and Changmin not to get involved with Crebaeu. The cosmetics business showed us a different side of jyj and sadly not a good one. I believe Yunho, Changmin and their fathers when they say it was the cosmetics business that caused the split because it was only after Avex and Sm asked jyj to quit the cosmetics business because it was bringing down tvxq's name (among other things), that they filed an injunction against Sm. I don't believe the contract is the real reason they left. Up till that point the contract was not an issue at all. Imo it was used as the means to get out of Sm but their parents signed those contracts and were explained to why those contracts were as long as they were. They scrutinized every detail of those contracts and signed on the dotted line. Anyway that's in the past but this letter from Avex reminds me of the unfair bashing that Yunho and Changmin went through because of decisions made by jyj and their families. It brings back terrible memories of just how bad it was after the split. The confusion and the bashing without proof and the silence of Yunho and Changmin for a very long time.

In fact other then the the temporary injunction CJS has yet to win any lawsuit in court despite there best effort to sue anyone who "supposedly" opposes them. Honestly I don't know where you are getting your information but there has been nothing to suggest or indicate that the lawsuit is going in either direction. Also it was the way your statement was worded that made it seem like you are a JYJ fan and your attempts to sway an opinion on that not a very good one. One doth protest to much. i can understand your frustration as its hard to come by news about the lawsuit that is actually unbiased. ALL kpop international news sites have been posting articles biased to JYJ due to JYJ's popularity with international fans. they haven't even bothered research the facts stated in those articles to decide whether they are legitimate or not (ex the articles claiming that SM does not own TVXQ's name, which as we can see on the KIPRIS site are false claims) they have always tried to hide any news that might bring disadvantage to JYJ or at least twisted the news so that it was in JYJ's advantage.
one such news is the one that carried statement by JYJ's own lawyers regrading how the contract with SM was already invalid after the injunction decision came out. therefore, fans naturally assumed that the court is siding with JYJ. reality is though, the court has never made a ruling on the validity of the contract up to this point.
u say that the court is siding with JYJ but if u check out JYJ3 u will see many pple complaining that the court is siding with SM, and that SM has bought the justice system. this was especially the case after SM recently won a lawsuit against some organization
the only thing the court has been doing so far is encouraging both sides to find a solution on their own that satisfies them both. however, that hasn't happened yet so the court will be making its own decision this month and both sides will have to stick with it.

Suddenly, here comes SM with strong evidence to back up their statements. this caused the whole thing to get really messy.
also, i never said that SM is 100% innocent in this matter. i said there are 2 issues with the SM's contract that may sway the court's decision to JYJ. the first is the length of the contract (13 yrs) which is too long, however, SM can jump over this problem if they provide decent statement with evidence about why its 13 yrs long. the second issue is the huge sum of money SM requires JYJ to make due to having breached the contract. I don't remember the actually amount of money but someone here can help you with that but i think it was $4.5 million USD. if the court finds that sum too much then JYJ may win.
honestly, I get where ur coming from, and im glad u have come here to ask becuz i know that this is the only place that will actually provide u with unbiased translations of important documents and many of us were actually on JYJ's side to begin with, and only through reading these documents did we realize the truth of the matter.
the ruling could go either way as both sides have their advantages and disadvantages, problem is win or lose SM will continue to get bashed.
personally if I were the judge, i would declare the contract to be valid as this will maintain order in the music industry and prevent others from signing contracts easily only to file lawsuits against them after they get popular. but then i would also decrease the sum of money that JYJ has to pay for damages and contract breach to something more reasonable and within Korean standards.
this to me seems like the best and most fair decision.
I'm not sure if I can compare with the American music industry vs. the Korean. But there has been plenty of cases where companies sue singers for breach of contract. It's usually around that much.

He was trained to dance, sing, act, host, model and everything for 7 years. American artists don't even have that or at least it's not noticeable.

DeleteHello, sorry for the late response. I've been swamped with work, and don't have much time lately.
One thing many people forget is that the lawsuit is ultimately about validating the contract, not everything that went around it. If you read my posts, I even said there's a good chance that SM may lose the lawsuit because of few sections in the contract that may be deemed unfair by the court. A lot of posts I wrote don't even have anything to do with the lawsuit itself, the biggest example would be the 6.25 meeting.
When you have time, I suggest reading my posts from the beginning, then you will have much clearer idea of what really went on, and you'll see (hopefully) that CJS is just using the contract as an excuse to get out of SM for their own gain.

no. the court tried to make the 2 sides find mutual agreement by themselves for the past 2 years. however, both sides have way too many differences and can't seem to agree on anything, therefore they have failed over and over again to reach an amicable settlement.
the problem would have definitely been solved if both sides had come to a mutual agreement but that didn't happen.
therefore, the court has now decided that they will be making a judgement as both sides have failed to reach a solution of their own.
now its up to the court to decide whether the contract is valid or not.
what i said about SM is that if they win, they will continue to get bashed even more so by JYJ stans and kpop fans in general about how they supposedly manipulated the court case, but if they lose they will also get bashed by JYJ stans and a lot of kpop fans in general becuz they now have a proof that SM's contract was unfair.
Just want to back up @sarahM's reply, particularly the no win-lose sitch you guys are discussing. In one of the earlier court sessions that was open to the public, the judge specifically said that he thought the best course of action was for the two parties to come to a mutual settlement, because it seemed that whatever verdict the court could give would result in losses to both sides anyway. To this SM said they were more than willing to negotiate, and JYJ side said they refused to negotiate. You can read an overview of that hearing here:

Also, I think the last hearing that was open to the public was around mid-2011, so it's strange that people are claiming the courts are favoring one side or the other. No one actually knows what's been going on. I think the only statements that have been released have been from JYJ's lawyers, who of course are not going to say anything except that JYJ is winning. SM has been very close-mouthed about the whole thing, which imo is expected behavior from a company like that. They're the biggest entertainment company in Korea, publicly traded, and their Hallyu stars have squeaky clean images. Going around talking about an ongoing lawsuit is not exactly the way to maintain a good public image.
And as far as SM or JYJ winning... Precious himself has stated several times that he can see the case going either way, and after reading up on stuff here and elsewhere I agree. I hope you take the time to look over posts at this blog and elsewhere as objectively as you can... and sidenote, AKP and Soompi are very very far from being unbiased and reputable sources. AKP always goes for the sensationalist 'news' bites, and Soompi TVXQ thread was chaos fangirl battleground for a long time - it finally split into 2 threads (now wholly independent of each other), and the HoMin thread mods and participants made the conscious decision to not talk about the lawsuit and JYJ. Simply because Yunho and Changmin are not involved in them in any way, and it always caused more strife than anything else. As a result, Soompi discussions of the lawsuit are heavily JYJ biased.
Can I say also, the purpose of this blog was never to prove SM "right" - the blog was started with the express purpose of defending Yunho and Changmin who were bashed like crazy for literally years by their own fandom. It sounds like you're not a TVXQ fan, so there's a lot of backstory you're probably not aware of. Um. Regarding Crebeau, I'm quite sure that there was news about the cosmetic business not being the cause of the lawsuit or something like that. The lawsuit against Crebeau by SM was dismissed but then again so was the lawsuit that Crebeau filed against SM. Technically while there was never any blame placed against Crebeau it was found by prosecutes that the boys of JYJ were not minority owners as they claimed. It was found out that they owned 62% of the company meaning they were the majority owners.
DeleteNow I must add while Crebeau obviously cannot be held accountable for any part of this lawsuit because it was found it was not there fault it could still be a part of the outcome in the end. The signing of the endorsement deal with Crebeau was still against the contract stipulations in there agreement with SM. All of these things are probably going to be gone over before a decision is made.

Deletehonestly its very difficult for me to predict becuz we don't know what has been submitted to the court over the past hearing sessions that were done in private. if this was in a Western country, then I would assure u SM would have already had in the bag. You just need to look at George Michael's lawsuit against Sony back in the 90s to see how rigid and strict the system is in such countries. I'm not sure how the Korean court system works (ie whether it does take into account the public opinion or not) so it really can go 50-50 in my opinion.
about the cosmetic business. LadyYejin has already explained it clearly but i will just expand on it a little. I know that international English Kpop sites like to ignore certain happenings so I would like to highlight those
1)SM representative made a public statement that Crebeau is the reason JYJ left SM and filed the lawsuit.
2)Crebeau filed a lawsuit against SM for defamation and interfering with its business.
-outcome:
a. The lawsuit was DROPPED as NO EVIDENCE was given to prove any defamation acts by SM
b. Korean DA (investigation team) found out that JYJ and their families owned 62.5% of the shares at Crebeau. this means that the President of Crebeau had literally lied when he said previously that JYJ were only minor investors with 1/10 of the shares. Clearly JYJ are MAJOR owners of the company. this is very important becuz it disapproved all the claims JYJ made early on about how they did not care for the cosmetic business since its only a small investment. they are pretty much the major shareholders, so we'r talking about HUGE sums of money going into their pockets from this business, not just few dollars. this also means that they invested probably hundreds of thousands of dollars (if not millions) to become such major shareholders. therefore, they would be crazy to step on this new business investment of theirs.
3)SM filed a counter-lawsuit against Crebeau for defamation and interruption of business, but lawsuit was dropped due to lack of evidence.

As explained above, Crebeau was the first one who brought themselves into the legal battle when they filed a complaint that SM was defaming them. There were never any statement by any official that "It has been proven that Crebeau is not involved". What was decided by the DA is that there is not enough proof that SM tried to defame Crebeau, and not enough proof that Crebeau tried to defame SM, simple as that.
Unfortunately the writing of the article about SM's counter suit being dismissed by the DA was given the headline along the line of "SM counter suit dismissed by court, Crebeau proven innocent in TVXQ's breakup", which is the headline quoted and spread by international news and kpop fans. Nobody seemed to see that the only reason SM filed a counter suit was because Crebeau filed a complaint first, a complaint that was thrown out by the court as well.

If I'm being a bit too blunt, I'm really sorry. But I can only relief my curiosity this way. I am just interested to know the opinions of people who have done their research, unlike me.
To be honest with you, some K-sites are actually biased to JYJ. I think this is because of the "sympathy" they felt with the issue of "slave contract." Let me clarify something first. The "slave contract" was never the first issue with all of this mess. The real issue was the involvement of JYJ and their family in the cosmetic business. Also, it was the Japanese fans who brought-up to the attention of Avex about how one of the members' mother was selling the cosmetic stuff during their concert in Japan. The issue of the "slave contract" was then brought-up after this. For me, it seemed that once this issue with the contract came-out, certain groups of people think that the trio were the only victims and SME was pure evil. Also, the fact that the news that you read in English K-sites are the translated versions from the Korean sites make it hard for the real facts to be incorporated to the translated versions.
DeleteMy advice to you is to do research. You can be lazy all you want, but if you want to further your understanding of this matter, you have to start researching about it. Look-up a site that also discusses this lawsuit and compare that website to the way this blog has been constructed. Only then you will see the difference and which site is actually biased to one group. I understand that this blog is already wordy and loaded with technical terms, but only then you will understand that this blog has no intention of defaming an artist. This blog only aims for the truth to come-out. Precious provides his readers with translations of this issue (translations of news), which are backed-up with official documents from the court.

I think Precious never said that his blog is unbiased but the facts that he found made him biased to Yunho and Changmin; you may disregard his opinions but the facts he found is unbiased. I think it’s better if you see this issue from many point of views with calm and open mind; from Yunho and Changmin, JYJ, SM and Avex before drawing some conclusions.

I think the girls above have answered your Crebeau query pretty thoroughly. As you can tell, the cases and verdicts and such are all wrapped up around legalese - the legally binding language and contracts of...such stuff. SM never filed a suit accusing Crebeau of causing the split. It's kpop "news" that added on the sensationalist headlines to imply that. And.. seriously, I know I'm repeating this for the umpteenth time, but because this was NEVER in kpop news:: Crebeau filed a lawsuit against SM FIRST, and it was dismissed due to lack of evidence. SM filed a countersuit, and it was similarly dismissed due to lack of evidence. Both cases were defamation lawsuits - which means that each party had to prove definitively that the other party operated in ways that directly and deliberately harmed their business. Cause and effect, not so simple a thing to determine when it comes to revenues and reputation. Imo, it is no surprise that both parties lost the case. I think SM should have played it cool and not filed the countersuit to begin with, but as a matter of pride... meh. Not the best course of action, but I can see why they did it. :/
As far as you wanting to just ask about bits and pieces you're particularly curious about, I see no harm in that. It's of course totally up to you how involved and interested you are in all this stuff. I mean, imo when it comes to the interwebs, it's pretty much always a good idea to do your own research about things you're particularly interested/curious about. While staying objective and cognizant of the fact that everyone and their mother can post anything online. But, obviously no one here is going to begrudge you asking questions! So... please feel free to ask away. :)

Yes. The court postponed it indefinitely. There must be a reason why the court decided on this. But I'm really disappointed that there is still no verdict. Although I see that the court want both parties to settle this matter out of court, I think that the court should just give a verdict and end all of this. This trial has been going-on for such a long time. Anyway, let's just enjoy TVXQ's Korean comeback and anticipate their world tour. It's about time that our boys have their own world tour. They deserve only the best for their hard work and dedication to their fans.

Just when the news of TVXQ world tour is announce, those 3's fan is twitting everywhere about the boycott of their idols. One is for SBS for PARA games as if the game was the opening was center around their idol. Taking the emphasis away from the game, shame on them. Another for KBS not showing their idol in the red carpet in BUSAN international film festival. Did they forget already that their idol and company sued KBS for boycott (guess they have really short term memory). Please, can't they realized not everything revolve around their idols. GRR... just needed to get this off. Sorry everyone for the rant.

ReplyDeleteAbout the JYJ's profiles being added into the TVXQ profiles, I think it's because there was an SM album that came out at the time, something about the best songs the SM groups produced, something like that I don't remember very clearly. I think SM wanted to give credit to JYJ for their past work in TVXQ, not only them but Hangeng's profile was also added to Super Junior's profile too. Now about, Homin and JYJ reuniting.....I don't think that's possible. Obviously something broke the five of them apart to make things become how they are now.
DeleteYunho still does think of them as friends, but I don't think he trusts them that much anymore. He can forgive them easily, I mean he did forgive the person who poisoned him. He's a really nice guy. Changmin....He's the type not to forgive them easily, muchless give them back his trust. He seems to be the type to not give his trust back to those who did those kind of things to him.
My whole opinion on the lawsuit. I just want it over with. It has been haunting Homin for two years now. It should have been over a long time ago. Personally I want SM to win. Both SM and TVXQ2 obviously showed that they could do well without JYJ around, there's just been news about their world tour tickets opening night have been sold out in three minutes after opening. SM released great groups like SNSD, Super Junior, SHINee, F(x) and EXO, after TVXQ debuted.
hmmm actually what happen if SMent win that lawsuit? my personal opinion actually i'm so sad, i want they comeback as 5. But after read this blog, i don't think :( and i also confused why they keep postpone the lawsuit, i mean that it should be end like around this year right. and the newest news from allkpop it has been postpone again until i don't know when. so sad :(

ReplyDeleteNow the other side cannot blame SM or makeup injunction excuses if they don't get invited on TV programs(variety/music) as welcome as they think. Finally freedom & a welcome relief for Yunho and Changmin (well in Korea anyway...then again there's Japan lawsuit with AVEX)
Precious its over. We still haven't got all the details that led to the decision on both sides withdrawing their lawsuits but I'm sure over the next few days some information will start to trickle over. Hope to hear what you think about the end of this lawsuit Precious.

Yes, I hope the other side won't blame SM again if TV station, variety shows or music shows still don't invite them to their shows; it's their right if they don't want to invite JYJ to their shows anyway. Now Cjes should find other name for JYJ fanbase because Cassiopeia / Bigeast and pearl red colour are exclusively only for TVXQ.
Finally its over....It's good to hear that this outcome wouldn't have too much repercussion as it would have, if it went to either one of the sides.

I agree with you guys about the TV stations thing. Over at AKP, there's a whole lot of people getting all excited about the chance of them seeing JYJ perform on a music show without SM "cockblocking" them. I especially agree with you about the fanclub idea. Many people would argue with it, but it's official. JYJ is no longer a part of TVXQ and that's that.

i only felt a pang of pity to those who are hoping for the 5 to be one again. i know that hope is hardest to kill... maybe i can empathize.
to me my hope is for TVXQ (HoMin that is) would continue to stand tall and shine brighter... one positive thing that all the events that happened is that i love yunho much much more and i learned to appreciate changmin and see his beauty too (before i am almost a pure yunho biased).
i also hope that if personal issues could be resolved quietly that they would do so. i doubt relationships like they have before would be the same but closure is important as to not have regrets in the future...

Because actually most JYJ fans (sorry for generalising >.<) always bash TVXQ and cassies. They go to TVXQ's articles and videos to leave comments about JYJ which always blew up into a huge fight -_- .
DeleteSorry, but I think there are equal amounts of JYJ and HoMin bashers, and some of them even pretend to be a fan of the other group just to spread hate (e.g. a fan says "HoMin are traitors" when fact is said fan is a TVXQ HoMin shipper, she says that to anger other HoMin fans and defend HoMin against "JYJ fan"). There's so much hatred and rivalry between the DB5K members that sometimes one can't help but think they HAVE to choose a side. FYI, MOST JYJ/ HM/ DBSK fans are mature, intelligent, articulate and open-minded. Those you see spreading hate and trolling around the interwebs are probably a bunch of 13-15 year old girls who are hell-bent on proving that one side is better than the other and that one side is the one at fault. I'm a DBSK fan through and through, I admit that I follow JYJ activities more since I like Xiah Junsu the best out of all 5, but that doesn't mean I hate or even dislike HoMin and the other 2 JYJ members. I'm mature enough to not spread all this hate and rivalry. No matter how eloquently put or how "informative" "facts" are said, some JYJ/HM fans will feel offended because some of them are 1) immature 2) overprotective 3) bashers 4) trolls. The best thing to do is to read whatever information is available, keep an open mind, DON'T BELIEVE everything that is written just because it says it's from a "reliable source" or it is "official". Unless and until you see a LEGAL document with signature and seals and you are 100% sure it is legitimate that you are 100% certain you could STAKE your life in its validity, NEVER put 100% of your trust in it. I know better than to comment on anything regarding this issue because I am not directly involved and I only know second-hand accounts of events. The best thing to do is to support your artist and IGNORE bashers/ troll, and NEVER be one.
